The new Partner visa changes commence from 17 April 2019

UPDATE POST 17 APRIL 2019 : The partner visa changes were placed on hold. We await an update from the department in regards to when the changes will commence. We still recommend you submit your partner visa ASAP to avoid delays and disappointment should the change occur with little notice.

 

Subsequent to our earlier post in January regarding the proposed changes to the Partner visa structure, the Department had made further announcements yesterday.

The new Partner visa changes will commence from 17 April 2019

Following passage of Migration Amendment (Family Violence and Other Measures) Bill in December 2018, the Governor‑General yesterday proclaimed that Schedule 1 of the Migration Amendment (Family Violence and Other Measures) Act 2018, would commence on 17 April 2019.

The new change will require the Australian partner to lodge their application and have this approved before the partner visa application can be lodged.

Time is of the Essence
This means that partner visa applicants with limited time remaining on their current visa will be required to either lodge another visa application that will allow them to stay in Australia legally, or go offshore and remain overseas until the partner visa is granted.
